Residents in at least five communities have used this argument over the last six months in challenges to their local authority’s release of Green Belt sites for development. All have failed.
Last December, in a judicial review, the High Court ruled against Guildford residents, thereby establishing case law on this matter.
Planning rules do, however, allow a community to protect their Green Belt sites from development by writing a Neighbourhood Plan.
If we wish to protect our Green Belt sites we need to use the new rules to our advantage, not ignore them.
